MizoProperty Terms and Conditions

These Terms and Conditions (Terms) govern your access to and use of the MizoProperty mobile application and related services (Service), operated by HillsTech (we, us, or our).
By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. About the Service
MizoProperty is a digital real estate marketplace for listing, discovering, and communicating about properties in Mizoram. The Service may include:
- user accounts and role-based access (buyer, owner, agent, admin)
- property listing creation and management
- map-based property discovery
- enquiry and in-app chat between users
- media uploads (images and videos)
- notifications and communication features
2. Eligibility and Account Responsibilities
To use certain features, you must register an account and provide accurate information.
You agree to:
- provide true and current account details
- keep your login credentials secure
- be responsible for all activity under your account
- promptly notify us of unauthorized account use
- Owners and agents may require approval before posting listings.
3. User Content and Listings
You are responsible for content you submit, including listings, descriptions, photos, videos, chat messages, and contact details.
You represent and warrant that:
- you have the rights and authority to post the content
- your content is accurate and not misleading
- your content does not violate applicable law or third-party rights
- By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute the content solely for operating, improving, and promoting the Service.
4. Prohibited Conduct
You must not:
- post false, fraudulent, deceptive, or illegal listings
- impersonate another person or entity
- harass, abuse, threaten, or spam other users
- upload content that infringes intellectual property rights
- attempt unauthorized access to systems, data, or accounts
- interfere with Service operation, security, or availability
- We may remove content or suspend accounts that violate these Terms.
5. Communications and Third-Party Features
The Service may provide call links, messaging, and WhatsApp redirection for user convenience. Communications with other users are at your own risk.
The Service may integrate third-party services (for example, Firebase and Google Maps). Your use of those features may also be subject to third-party terms and policies.
6. No Brokerage, Advice, or Transaction Guarantee
MizoProperty is a platform connecting users. We are not a party to negotiations, contracts, payments, title transfers, tenancy agreements, or property inspections between users.
You are solely responsible for:
- verifying property details and ownership
- conducting due diligence
- obtaining legal, financial, and technical advice as needed
- complying with applicable real estate and local laws
7. Payments and Fees
Unless explicitly stated in the app, basic use of the Service may be free. If paid features are introduced, pricing and billing terms will be displayed in-app and/or in updated legal documents.
8. Intellectual Property
All rights in the Service (excluding user-provided content), including software, branding, design, and text, are owned by or licensed to us and protected by law.
You may not copy, modify, reverse engineer, distribute, or commercially exploit any part of the Service without prior written permission.
9. Suspension and Termination
We may suspend, restrict, or terminate your account or access at any time, with or without notice, if we reasonably believe you violated these Terms, applicable law, or created risk to users or the platform.
You may stop using the Service at any time. You may request account deletion as described in our Privacy Policy.
10. Disclaimers
The Service is provided on an as-is and as-available basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
We do not guarantee:
- listing accuracy, availability, or suitability
- user identity authenticity
- successful communication, negotiation, or transaction outcomes
- uninterrupted or error-free operation
11. Limitation of Liability
To the fullest extent permitted by law, HillsTech and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from or related to your use of the Service.
Where liability cannot be excluded, our aggregate liability will be limited to the amount you paid (if any) for the Service in the 12 months preceding the claim.
12. Indemnity
You agree to defend, indemnify, and hold harmless HillsTech, its affiliates, and personnel from claims, liabilities, losses, and expenses arising from your content, your use of the Service, or your violation of these Terms or law.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Courts located in Mizoram, India will have jurisdiction over disputes, subject to applicable law.
Before initiating formal proceedings, you agree to contact us and attempt a good-faith resolution.
14. Changes to These Terms
We may update these Terms from time to time. Updated Terms become effective when published in the app or on our official documentation channels, unless otherwise stated.
Your continued use of the Service after updates indicates acceptance of revised Terms.
